Item Challenging Predictions of Uniform Civil Code for India: An analysis(2014) Kumar, DeepakThe conception of Uniform Civil Code in India is a term mentioning to an primary Civil Law Code. The Uniform Civil Code brings the idea of the same set of civil rules for the citizens irrespective of their religion, caste, creed etc. Civil law administers the matters relating to marriage, adoption, inheritance, succession and so on. India has adopted the concept of secularism and thus such matters of the citizens are still governed by the personal laws of their respective group of peoples. It’s the mandate upon the state as a directive principle of state policy to propagate a Uniform Civil Code for the whole country. The problem has various views and basic concern as of law, order and machinery and leads to the emerging issues to the national security.Item Impact of laws for prevention of pollution from crop residue burning : In context to the State of Punjab(2015) Kumar, DeepakPunjab hasthe most fertile land for agriculture activities in India and ideal for grown wheat, rice, sugar cane, fruits and vegetables. Punjab is, also called the "Granary of India" or "India's bread-basket."It produces 4% of India's wheat and 15% of India's rice. Thus the state is putting great contribution in the development of the country as well as to fill the food basket. But a common practice repeated by majority of the farmers is burning of residue came out from the crops. This practice of residue burning has become one of the major reason of air pollution particularly during harvesting season and has major direct and indirect on the life of living beings, biodiversity and environment in the country. The same time it adversely affects the air quality, leads to nutrient loss, degrade soil properties and cause waste of residue that has now considered tremendous resource worldwide.Item Right to Healthy Environment in India: A Judicial Perspective(Amitesh Publisher, 2015) Kumar, DeepakEnvironment and environmental rights, play a fundamental role in human life and also help in developing the values for the protection of environment. Entire life on the earth can survive with the protection and improvement of the environment and in this way right to environment has emerged as a human right. The Supreme Court and the High Courts in India have played a distinguishing role in expanding the scope of a meaningful life by applying various issues of environmental protection, resulting to that the activities posing threat to the natural resources were shortened. The judiciary in exercising the power of judicial review and developing the concept of judicial activism and by using the weapon of PIL have protected the individual's inherent right to wholesome environment as a fundamental right under Art. 21 of the Indian Constitution. Art. 21 has been trusted in a number of cases as a great tool by way of interpretation, and specifically certain cases have given a wider perspective of the Right to life. The right to live in healthy environment, including right to clean and safe drinking water, fresh and clean air etc., is continuing to gain recognition. This paper tries to discuss diverse ingredients of Indian environmental jurisprudence. Analytical method of research has been followed in this piece of research. Focus has also been given on the judicial experiences in the development of right to healthy environment as a fundamental right under Art. 21. Acknowledgements of the Fundamental rights and the concept of justice of all kind in the constitution is strong evidences of the adoption of the concept of Rule of Law. These practices with easy work efforts combined with the social, economic, and political components and prepared the foundation in social values.Item Specific Environmental Laws in India: With special reference to Control of Pollution from crop Residue Burning(2014) Kumar, DeepakAgriculture is the backbone of Indian Economy and important way for the survival of Farmers, while near about 70% persons is surviving with the agriculture activities. The income from the agriculture is not enough for survival and a number of farmers are bound to suicide in a number of regions in the country. Less income as well as traditional ways and techniques along with the less support from Government are responsible for this situation of farmers. One of the major problem is also connected with same issue that the farmers are not having proper means of disposing off the residues from crops. The legislature have enacted general laws for the protection of environment and these laws are also known sectorial laws also. The effect of these laws are common for all kind of acts prohibited under environmental laws. Hence the farmers are under the purview of these laws and punishments, even getting nothing as reward or monitory benefits while practicing burning of crop residue.
